Terms of Service
Welcome to AudioVibe. These Terms of Service ("Terms") are an agreement between you and Alpha Tech Labs Ltd, a company registered in England and Wales under company number 17015966 ("AudioVibe", "we", "us"). They govern your use of the AudioVibe mobile apps, websites, and related services (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use AudioVibe
- You must be at least 13 years old.
- If you are under 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.
- You must not be prohibited from using the Service under any applicable law, and any account we previously disabled for breaking these Terms may not be re-registered without our permission.
1a. Age-restricted content
Some content on AudioVibe is rated for adults only. We label content as general, mature, or 18+, and creators must rate what they upload.
18+ content is currently switched off for everyone. Turning it on requires age verification, and we have not launched age verification yet. Until we do, no account can see content rated 18+, whatever their age. We will update these Terms and tell users when that changes.
- 18+ content is hidden by default, and is shown only to accounts that have turned it on in Settings.
- Two things are required to turn it on: a declared date of birth of 18 or over, and completing our age verification check. Both are required; a date of birth on its own is not enough.
- Content rated mature is treated differently from 18+: it is shown to accounts whose declared date of birth is 18 or over, without a separate opt-in or verification.
- You must give an accurate date of birth. Giving a false date of birth to reach age-restricted content is a breach of these Terms, and we may remove or restrict the account.
- Rating your own uploads accurately is your responsibility. We may re-rate content, and we may act against accounts that repeatedly mislabel what they post. Creators may label their own account or uploads as 18+ whether or not they have completed age verification, because rating your work honestly must never be harder than leaving it unrated.
- Sexual content involving anyone under 18 is never permitted, whatever the rating. See section 5.
2. Your account
- Keep your login credentials secure. You are responsible for activity on your account.
- Provide accurate information and do not impersonate any person or organisation.
- Tell us promptly at generalinquiries@audiovibe.co if you believe your account has been compromised.
- You can delete your account at any time from the app's settings. Deletion removes your profile, content, and files from the Service. If you cannot use the app, you can request deletion instead: see https://audiovibe.co/delete-account, which sets out exactly what is removed and what is kept.
3. Your content
AudioVibe is built on what you create: audio posts, series, episodes, playlists, stories, voice and text messages, comments, images, and profile information ("Your Content").
- You own Your Content. These Terms do not transfer ownership to us.
- Licence to operate the Service. So we can run AudioVibe, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, transcode, adapt (for example compressing audio or resizing images), publish, publicly perform, and distribute Your Content, solely in connection with operating, promoting, and improving the Service. This licence ends when you delete the content or your account, except where content has been shared with others (for example a voice message already delivered to a recipient) or where retention is required by law.
- You are responsible for Your Content. You must own or have the necessary rights (including to any music, recordings, or other material it contains) to everything you upload, and Your Content must not violate anyone's rights or any law.
- Visibility. Content you post publicly can be seen, played, and shared by others, including on public share pages. Private-account content is limited to approved followers. Messages are visible to their participants.
4. Copyright and claims
We respect intellectual property rights and expect users to do the same.
- We use audio fingerprinting to detect duplicate or unauthorised re-uploads at upload time.
- If you believe content on AudioVibe infringes your copyright, contact us at generalinquiries@audiovibe.co with: your contact details, a description and location (link) of the material, a statement of your good-faith belief that its use is unauthorised, and a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorised to act for them.
- We may remove content, and we suspend or terminate repeat infringers.
- If your content was removed following a claim and you believe this was a mistake, you may send a counter-notice to the same address.
5. What you must not do
- Upload content you do not have rights to, or that is unlawful, defamatory, or invades another person's privacy.
- Harass, threaten, bully, or abuse other users, or post content that incites hatred or violence.
- Post sexual content involving minors, or any content that sexualises or endangers children. See section 5a for exactly what happens when this is reported.
- Impersonate others, misrepresent your affiliation, or engage in deceptive practices such as spam, fake engagement, or scams.
- Attempt to probe, breach, or test the security of the Service; access other users' accounts or non-public data; scrape the Service at scale; or interfere with its operation.
- Reverse engineer, decompile, or create derivative works of the apps, except where the law expressly permits.
- Use the Service to distribute malware or run automated bulk activity without our written permission.
5a. Child sexual abuse material
This is the one category we treat differently from everything else on the Service, and we set out exactly what happens so you can hold us to it.
When content is reported under the child safety category, all of the following happen immediately and automatically, before any person has looked at it:
- The evidence is preserved. A complete copy of the content, the account that posted it, and the surrounding details is written to a separate record that cannot be deleted by the account holder, by the reporter, or by ordinary moderation. It survives deletion of the content and closure of the account.
- The content is taken out of circulation where technically possible. Audio, series, stories and comments are withdrawn from public view at once. A direct message already delivered to its recipient cannot be recalled from their device, and we do not claim otherwise.
- The case is raised for urgent human review in a queue used for nothing else.
Referral. A person at Alpha Tech Labs Ltd reviews every such case and refers it to the appropriate authority, which in the United Kingdom means the National Crime Agency (including CEOP) and, for imagery, the Internet Watch Foundation. We record who made the referral, when, and the reference the authority gave us. If we decide a report is not what it appeared to be, that decision is recorded with the reason and the record is kept; it is not deleted.
What we do not do. We are being specific because vagueness here helps nobody: we do not scan content proactively, we do not use automated CSAM detection such as hash-matching, and we hold no direct reporting integration with any authority. Referral is a human step. We will update this section, and tell users, if that changes.
Retention. Records created under this section are kept even where you ask us to delete your data. UK GDPR permits this where retention is necessary for a legal obligation or for the establishment, exercise or defence of legal claims, and both apply here.
6. Moderation and enforcement
- You can report content, messages, and accounts from inside the app, and you can block another account so that neither of you can contact or see the other.
- We review reports and may remove content, apply an age rating, restrict features, or suspend or terminate accounts that break these Terms.
- We may also remove content or suspend accounts where the law requires it, or to protect the Service and its users.
- We will tell you what we did and why. If we remove your content or restrict your account, we will notify you, identify what was affected, and give the reason, unless we are legally prevented from doing so or telling you would undermine the prevention or detection of crime.
6a. Complaints and appeals
If you think we got a moderation decision wrong, you can challenge it, and we will look again.
- How to appeal. Email generalinquiries@audiovibe.co within 30 days of the decision, quoting the notice we sent you and telling us why you think it was wrong.
- What we do. The appeal is reviewed by a person, and wherever practical not the person who made the original decision. We aim to respond within 14 days.
- Outcome. If we agree with you, we restore the content or lift the restriction and tell you. If we disagree, we explain why.
- Other complaints. You can use the same address to complain about anything else in how we run the Service, including how we handled a report you made about someone else.
- Complaints about how we handle your personal data are covered separately in our Privacy Policy, which also explains your right to complain to the Information Commissioner's Office.
6b. Your enforcement record
Section 4 says we suspend or terminate repeat infringers. That is a promise about a record, so this section says what the record is.
- What we keep. Two things count against an account: reports from other users that we reviewed and upheld, and strikes, which are decisions a member of our moderation team made directly. A strike carries the reason it was issued and who issued it.
- Why both. Some content is found by our own review rather than reported by anyone. Without a strike there would be no record of it at all, and an account could break the rules repeatedly and still appear to have a clean history.
- A strike is not automatic. Content being removed, withheld, or age-rated does not by itself create one. A person decides, separately, that the account's standing should change.
- Effect. We take your record into account when deciding what to do about a later report. Accumulated strikes can lead to restricted features, suspension, or termination. There is no fixed number that triggers this; the decision is made by a person looking at the whole record.
- Appeals. You can appeal a strike the same way as any other decision, under section 6a above. If we withdraw a strike it stops counting against you, and we keep the record that it was issued and withdrawn so that you can point to it later.
- Retention. Strikes currently have no expiry. If we adopt a period after which they stop counting, we will say so here.
7. Our licence to you
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the AudioVibe apps and Service for their intended purpose, subject to these Terms. All rights in the Service (excluding Your Content) remain ours or our licensors'.
8. Third-party services
The Service integrates third-party services such as Google sign-in and, where you choose it, importing your own content from platforms like YouTube. Your use of those services is subject to their own terms. You must only import content that you own or have rights to.
9. Changes to the Service and to these Terms
- AudioVibe evolves constantly; features may change, be added, or be removed.
- If we make material changes to these Terms we will give you reasonable notice (for example in the app), and your continued use after the effective date means you accept the updated Terms. If you do not accept, stop using the Service and delete your account.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, about the Service, including its availability, reliability, or fitness for a particular purpose. Content on the Service belongs to the users who post it; we do not endorse it.
11. Limitation of liability
Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we will not be liable for indirect or consequential losses, loss of profits, data, or goodwill, and our total liability arising out of or relating to the Service is limited to the greater of £100 or the amounts you paid us in the 12 months before the claim. If you use the Service as a consumer, your statutory rights are unaffected.
12. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination (including 3 to 5, 10, 11, and 13) survive.
13. Governing law
These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, except that consumers resident elsewhere keep the protection of mandatory rules and courts of their country of residence.
